Buyers assume the agent they contact represents their best interest. The State of Florida assumes ALL real estate buyers know ALL real estate brokers and their agents are Transaction Brokers or Transaction Agents who DO NOT represent them exclusively. A broker or agent who chooses to represent only the buyer must make written disclosure to the buyer. When the broker will be acting exclusively in the buyer’s best interest they are working as a “Single Agent.” They are telling the buyer they will only represent their side of the purchase transaction as their buyer broker or buyers agent.

A buyer broker contract or agreement (not used by Florida Buyer Broker) obligates the buyers to pay the broker any balance of commission the buyers broker does not receive from the shared commission offered by the seller’s agent or by a builder or developer to the buyer broker office, based upon the agreement the office requires a buyer to sign.
Florida Buyer Broker accepts the compensation offered in the MLS by the seller’s agent and by builder’s to buyer brokers as the total compensation in the real estate transaction.
Only a buyers broker can legally negotiate for the lowest price and best terms for the buyer . The buyers broker must keep the buyers financial status and motivation confidential. Florida Buyer Broker is an “Exclusive” Buyer Broker. The word Exclusive used with Buyer Broker means that the brokerage never represents sellers. There is never a conflict of interest between the buyers and the sellers. REALTORS® designate exclusive buyer brokers or a buyers agents with the initials EBA which means Exclusive Buyer Agency.

Accounting: A buyer broker must account for all entrusted funds.
Confidentiality: A buyer broker must withhold the financial status of the buyer from the seller and his agent, unless directed otherwise by the buyer.
Reasonable Care and Diligence: A buyer’s broker is required to perform with a higher standard of care concerning the buyer/client.
Disclosing all know facts that materially affect the value of the residential real property which are not readily observable.
